DEP Letter
of November 1, 2007
Randy's Letter to Representative George of November 6, 2007
Randy also made the following comments:
"The third paragraph of
Secretary McGinty's letter represents a significant change in DEP
enforcement policy, which all operators should be aware of. DEP enforcement
staff can no longer threaten operators with personal monetary
penalties for minor violations as they have in the past; they must first
issue an Order, and the Order must then be violated before any penalty can
be imposed. Operators should also be aware that all Orders can be
appealed and DEP must prove that they are valid under "normal" rules of law:
strict liability does not apply to Orders."

RANDY HURST REGARDING THE ISSUE OF OPERATOR LIABILITY..... YOUR ACTION
IS REQUIRED TO ASSURE A MORE REASONABLE INTERPRETATION!!!!!
