IMPORTANT!!!!!!

Our response to Secretary McGinty's letter has had an effect.  Please see attached letter from Representative George.   If you have not seen the Secretary's letter and our response, please visit the EPWPCOA website: epaops.org and look under government affairs.  Follow THIS LINK FOR LETTERS...

Randy Hurst has received a copy of letter from DEP and has issued a response.  These letters appear below:

Hurst EPWPCOA Letter of 2-26-08

Representative Brutz Letter of 1-11-08

Representative George Letter 12-13-07

Randy's Letter to Representative George of 1-2-08

DEP Letter of November 1, 2007

Randy's Letter to Representative George of November 6, 2007

Randy also made the following comments:

"The third paragraph of Secretary McGinty's letter represents a significant change in DEP enforcement policy, which all operators should be aware of. DEP enforcement staff can no longer  threaten operators with personal monetary penalties for minor violations as they have in the past; they must first issue an Order, and the Order must then be violated before any penalty can be imposed.  Operators should also be aware that all Orders can be appealed and DEP must prove that they are valid under "normal" rules of law: strict liability does not apply to Orders."

PLEASE SEE LINK BELOW FOR INFORMATION FROM RANDY HURST REGARDING THE ISSUE OF OPERATOR LIABILITY.....  YOUR ACTION IS REQUIRED TO ASSURE A MORE REASONABLE INTERPRETATION!!!!!
